THE BOOKING CONTRACT
Nature Himalaya Adventure is a Private Limited Company associated with Nepal Government(registered number:181856) accepts your reservation or booking under the following terms and conditions.
By booking or join in a trip or any related services products you accept that you have read, understand and agree to be bound by these Terms. Both parties agree to these Terms and Conditions to resolve any legal or other controversies that may arise during the trip.
BOOKING A TRIP
Your booking is confirmed and a contract exists when our tour operator issues a written confirmation after received the applicable deposit amount. Please make sure your confirmation carefully and report to our tour operator for any correction or changes immediately and make sure that names are exactly as mentioned in the relevant passport.
BOOKING ON BEHALF OF OTHERS
By booking on behalf of other participants, you are responsible for making all payments due in connection with your Trip booking, informing the Tour Operator if any changes or cancellations are required and keeping your party informed.
By booking on behalf of another person(s) or participant(s), you represent and authorization that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and Nature Himalaya will not be liable to any warranty, errors, exclusion or for any circumstance condition in the information provided to complete a booking.
To secure your place and to process the confirmation at the time of your booking, for the Nepal Trips, a non-refundable deposit of 25 % of the trip cost is required and you can pay the remaining balance upon your arrival in Kathmandu prior to trip departure. If the booking is made 15 days or less prior to departure, full payment is required at the time of booking. While booking for Tibet, Bhutan and India trips, a non-refundable advance deposit of 25% is along with applicable airfares (if you want to arrange it through the company) and final payment should be made 15 days or more prior to departure. For booking an expedition, a non-refundable deposit of 25 % of the trip cost is required more prior to Trip departure. If any booking on an Expedition Tour is made 90 days or less prior to the departure of such trip, full payment is due at the time of booking. We need advance payments on your behalf for fixing prior arrangements for flight ticket, hotel reservation, transportation ticket, permit, TIMS card etc.
Booking deposit transfer is accessible whether you made by bank transfer or by Credit Card (Visa or Master Card). We also accept the Bank cheque / Western Union / Cash - US Dollar, Canadian dollar, Pound, Euro, Australian Dollar, Singapore Dollar, Hong Kong Dollar, Japanese Yen, etc. Please follow the information given on the booking form. You are suggested to think carefully while filling up the necessary details information in transferring fund from any payment methods. Please also send a copy of your passport or any ID copy along with the filled form. The Company will send also email details for making payment once after fill up our Booking form.
(1) Payment by Credit Card (MasterCard or Visa Only)
Please complete the required information in the form including your credit card details, signature (same as in your passport & Credit Card) and e-mail the filled form to Nature Himalaya Adventure.
Note: There is a 4% surcharge when you make the payment by a credit card.
(2) Payment via Wire/Bank Transfer
Please Contact Us for bank details.
E-mail us the bank reference number or remittance slips after you initiate the transfer, it will be easy for us to check.
The tour operator is not responsible for any delay or loss during the transfer process or charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to the Company.
Trip CANCELLATION BY YOU
If you forced for any cancellation must be made in writing and approved by the Company and after received your request for cancelation by the company will determine the cancellation charge applicable.
If you cancel your booking, the deposit amount will be held as a “Lifetime Deposit” as these Terms. Lifetime Deposits have no expiry and may be applied towards payment of a deposit on any other Tour offered by the company. The Lifetime Deposit is transferable and may be transferred by you to another individual of your choosing by providing notice to the Company in writing. If you forced to cancel or delay a trip, you’ll find the next adventure by next time when you prefer. The remaining of the payments made to the company in respect of the canceled service will be refunded.
(a) Cancellation received 60 days or more prior to trip departure in relevant booking: Lifetime Deposit will be held by the Company as these Terms; the remainder of the payments made to the Company in respect of the canceled Trip will be refunded.
(b) Cancellation received 59-30 days prior to trip departure in relevant booking: Lifetime Deposit will be held by the Company as these Terms, an amount equal to 50% of the remaining of the payments made to the Company in respect of the canceled Trip will be refunded.
(c) Cancellation less than 30 days prior to trip departure in relevant booking: Lifetime Deposit will be held by the Tour Operator in accordance with these Terms, and no further refund will be refunded.
Please note that no refunds will be made if you freely leave a trip for any reason after the trip has started.
TRIP CANCELLATION BY THE COMPANY
The Company guarantees that all scheduled trip departures booked and secured with a valid deposit will depart as a designated date; however, the trip may be subject to change due to some unpleasant or critical circumstances and safety concerns.
The Company reserves to cancel any trip, including a guaranteed trip, before to departure due to regions such as flight cancellation, weather conditions, natural disasters, industrial action, strikes, wars, sickness, quarantine, government interference, or another unpleasant happening, the Company will be refunded the trip price only, or you are free to take an alternative trip of the same value.
The Company is not responsible for any incidental expenses or consequential losses that you incur as a result of the canceled booking including visas, vaccinations, non-refundable flights or rail, non refundable other fees, loss of earnings, or loss of enjoyment, the Tour Operator reserves the right to issue a full refund in instead of the alternative choices, in its solitary discretion. The significant part of a Trip as described cannot be provided after departure, the Company will make appropriate alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, the Company may provide you with a refund for unused products or services as determined in its discretion.
DETAILS REQUIRED FOR BOOKING
You must provide the right information as requested by the Company. If you unable to provide all required information before to the date on which full payment is required, a managerial fee will be charged for any costs incurred by the Company as a result of your failure to provide the correct information.
If you fail to deliver the information required for permits, air tickets, or other inclusions, the Company also reserves the right to treat the relevant factor of your booking as canceled and any cancellation fees consider reasonable by the Company, in its single discretion. The information required by the Company will differ by Tour and will be talking to you during the booking process. The Company wills not liable for any fees you incur as a result of errors, late, misplaced or any incomplete information you have provided.
REQUIRED MEDICAL INFORMATION
The Medical information must be provided to the company. If you have any pre-existing medical conditions any physical condition which may impact their ability to travel, participate in a Trip, travel to remote areas may harmfully affect the experience of others participants on your Tour.
You agree to complete the Medical Form honestly and to disclose all relevant medical information accurately and fully. The company reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a Tour.
The company reserves the right to deny you permission to travel or participate in any aspect of a Tour at any time and at your own risk and expense where the Tour Operator decide that your physical or pregnancy mental condition renders you unfit for travel or you represent a danger to yourself or others. Medical services differ from country to country and the Company is not reliable and gives no warranties in relation to the standard of such treatment.
Travel insurance is required in to join on any of our adventures. When choosing a travel insurance policy please tolerate in mind that every client should have medical coverage for repatriation and emergency rescues like helicopter, treatment and the policy also covers personal liability, cancellation, curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience while traveling.
Travel insurance is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. We suggest you for advising your insurer of the type of travel, activities, and destinations and included in your booking so that the insurer may present appropriate coverage.
PRICES, SURCHARGES, AND TAXES
The declared price of the Trip and any services offered by the Company is subject to change at any time, before or after booking confirmation, up to 30 days before departure. All trips are priced and published exclusively of applicable sales taxes. After a confirmation invoice has been issued, the company reserves the right to impose surcharges on any products or services booked for cause arising from increases in fuel costs, transportation costs, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at airport charges, local operator costs, currency and exchange fluctuations, increases in taxes, or government act which impacts the price of the applicable services.
FLIGHT DELAYS AND CHANGES IN THE ITINERARY
Sometimes the adventure in mountain uncertain. Usually, the flight is a delay or cancels due to rapidly change or bad weather. In this case, you’re free to choose an alternative trip to any other region. If you not interested in the alternative trip and would rather than wait for the desired trip, you are welcome to wait to get a flight. However, there be no refund and if you lose time waiting at the airport and don't take an alternative tour or you only do a short trek later due to time limitation.
The Company is not responsible for changes in air itineraries or flight times that impact your onward travel schedule, but we tend to assist you to make alternative arrangements as much as possible. The company reserve to make some changes in the itinerary due to unexpected circumstances.
It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure, and travel to each country or destination. All travel documents like as visas, permits, and certificates (including vaccination or medical certificates), insurance policies and a passport (with minimum 6 months validity) required by the relevant governmental authorities. You accept full responsibility for obtaining all such documents, prior to the start of the Tour, and you are only responsible for the full amount of costs incurred as a result of missing or defective documentation that is a direct result of your failure to secure or be in possession of proper travel documentation. You agree that the Company is not responsible for any errors or omission in this information.
The Company reserved to change or modify all itineraries, dates, prices of Trips at any time and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be charged in accordance these Terms. You admit that you are responsible for keeping up to date on the specific details of your Trip and any other services.
ACCEPTANCE OF RISK
The company would not be liable anyway for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred or other conditions suffered by you during the trip operated by the company. By traveling with the company you understand that you have considered any potential risks to health and safety. You would be responsible for all such risk arising in traveling, specifically participating in adventurous activities as such included in Trip itineraries or offered by the Company.
THE TOUR OPERATOR IS NOT LIABLE FOR THIRD PARTY SUPPLIERS
Third party suppliers are essentials to organize a trip successfully for arrangements of accommodation, activity, airlines, transfer operators, shore excursion operators, tour and local guides, and other independent to provide you with some or all of the parts of your booking. Although the Company takes all reasonable care in selecting Third Party Suppliers; sometimes the Company is unable to control Third Party Suppliers in some cases.
The Company reserves the right to update or modify these Terms at any time. An amended copy of these Terms may be accessed at any time on the Company’s website and will be sent to you upon written request to the Company. You are deemed to have accepted any amendments to these Terms on the Company’s website. The Company recommends that you refer to the Terms prior to travel to familiarize themselves with the most up-to-date version available.
